Hi I’m Chip Forstall,
Today we’re gonna talk about litigation, something that scares most people. They're like, “Oh my God, we gotta go to court, we’ve got to file suit”. It’s not a big deal. Let me tell you a fact that most people don't realize. We settle anywhere between 60 and 70% of our cases before litigation, and one of the reasons is is because they know that if they don't pay us, we will file a suit and we will go to court. That's what we do. Now, what does that mean? We prepare a petition. A petition is filed in the court. The sheriff serves that upon the insurance company the defendant driver, they then file they call an answer to the petition is basically written questions asking our client facts of the case, facts of their treatment, which we answer. In the old days, that would be sufficient. The two lawyers would get together and try to get the case settled. Things aren't quite like they were in the old days. Today it’s a little bit more difficult. Most of the time now they want to take the clients deposition, which just sit down in front of a court reporter, they ask you a bunch of questions about the case about yourself, it's really not that difficult. After the deposition, we again try to settle the case. If we can't settle the case, at that point in time, we file a motion for a status conference. Sometimes we'll file a motion for pretrial status conference to settle the case sometimes it’s motion just to get a trial date cutoff date, so we can work towards trial. So a lot of insurance companies will not pay until there's a trial date hanging over their head. Remember, our job is to get you everything that you deserve.
